Terms of Use.

These terms govern access to Tapture cards, hosted profiles, contact capture, messaging and AI-assisted follow-up tools.

Last updated September 22, 2026
Plain-language note

Tapture helps you share information and manage follow-up. You remain responsible for the messages you send, the data you upload and the decisions you make.

1. Agreement and eligibility

By accessing or using Tapture, you agree to these Terms and our Privacy Policy. You must be at least 16 years old and able to enter a binding contract. If you use Tapture for an organization, you confirm that you have authority to bind it.

2. Accounts and card claims

A physical card may have a unique claim link. The first valid claimant becomes the account holder for that card. Keep claim links and sign-in links secure. You are responsible for information entered through your account and for promptly telling us about unauthorized use.

3. Free trials, membership, billing and referrals

Eligible demo cards include a 30-day trial beginning when the card is claimed. At the end of day 30, the demo card link and hosted profile are disabled unless the account has an active paid membership. A trial does not automatically become paid and no payment method is required to claim a trial card. Memberships renew at the interval shown at checkout until cancelled. Branded email domain service, when selected, is charged annually at the price shown at checkout alongside the membership. Taxes, refunds and cancellation rights are handled as described at checkout and as required by applicable law.

Each eligible account receives a personal referral link. A qualifying referral earns the referring account a $10 CAD invoice credit after the referred customer’s first successful paid Tapture transaction. Credits reduce future Tapture invoices, are not cash, and are not transferable. Self-referrals, duplicate customers, refunded or fraudulent purchases, and manipulated attribution do not qualify. Tapture may correct, reverse or suspend credits issued in error or through abuse.

4. Acceptable use

You may not use Tapture to send unlawful, deceptive, harassing or unsolicited messages; impersonate another person; scrape or enrich data without lawful authority; upload malicious code; interfere with the service; or violate privacy, anti-spam, intellectual property or consumer protection laws.

5. Contact data and communications

You are the sender and controller of communications initiated from your profile or account. You must have a lawful basis and any required consent before contacting a person. Commercial messages must include required sender identification and an effective unsubscribe method. Tapture may suspend sending when consent, complaint or deliverability risks are detected.

A new email domain or mailbox needs time to build sender reputation. If you choose Fast (instant sending without Normal warming), your messages may land in spam or be rejected. By choosing Fast, you acknowledge that sender reputation and email health must be earned over time through responsible sending. Normal warming helps build reputation gradually, but neither option guarantees inbox placement.

6. AI-assisted features

AI features may draft text, identify possible public profile matches, summarize activity or suggest next steps. Results can be incomplete, outdated or wrong. You must review outputs before relying on or sending them. Tapture does not guarantee that a profile match, email address, lead signal or recommendation is accurate, and the service is not legal, financial, employment or professional advice.

7. Your content and licence

You keep ownership of content you submit. You grant Tapture a limited licence to host, process, reproduce and display it only as needed to operate, secure and improve the service. You confirm that you have the rights and permissions required for that content.

8. Tapture property

Tapture, its software, designs, branding and service content are owned by Tapture or its licensors. Except for the limited right to use the service under these Terms, no rights are transferred to you.

9. Third-party services

Tapture may rely on payment, email, hosting, calendar, social-network and AI providers. Their services and terms may apply separately. We are not responsible for third-party outages, policies or content.

10. Availability and disclaimers

The service is provided on an “as available” basis. To the fullest extent permitted by law, we disclaim implied warranties, including merchantability, fitness for a particular purpose and non-infringement. We do not promise uninterrupted availability, a specific business outcome or successful delivery of every message.

11. Limitation of liability

To the fullest extent permitted by law, Tapture will not be liable for indirect, incidental, special, consequential or punitive damages, lost profits, lost opportunities or loss of data. Tapture’s aggregate liability for claims relating to the service will not exceed the amount you paid to Tapture in the 12 months before the event giving rise to the claim. These limits do not apply where prohibited by law.

12. Suspension and termination

You may stop using Tapture at any time. We may suspend or terminate access for non-payment, misuse, legal risk, security risk or breach of these Terms. Provisions that by their nature should survive termination will survive.

13. Governing law and disputes

These Terms are governed by the laws of Ontario and the federal laws of Canada that apply there, without regard to conflict-of-law rules. Courts located in Ontario will have exclusive jurisdiction, subject to any consumer rights that cannot legally be waived.

14. Changes and contact

We may update these Terms and will post the revised date. Material changes will be communicated when required. Questions can be sent to hello@tapture.co.
